Divorce Mediation MA

As an Ipswich divorce lawyer, divorce mediation is a critical part of my practice and an area where I have extensive experience. In fact, I have been certified by the Massachusetts Council on Family Mediation, a designation that is reserved for members with significant mediation experience, advanced training and education.

What Is Divorce Mediation?

Divorce mediation is a way for you and your spouse to take charge of your divorce. It is for people who want to avoid the expense and animosity that comes with a court battle during divorce litigation. It is also for people who think that they can craft a better divorce agreement  than a judge who has a couple of hours (or less) to learn about their situation.

How Does Divorce Mediation Work?

During divorce mediation my role, as mediator, is to direct the negotiations between you and your spouse. The divorce negotiations take place in a series of face to face meetings at my office. I make sure that you have the financial and other information that you need to discuss the contested issues. Everyone has an opportunity to express their thoughts and concerns. The goal is to reach a divorce agreement that everyone can live with.

As your divorce mediator, I will give you a list of issues that you need to include in your Divorce Agreement. I also coordinate the exchange of financial records and other information that will be needed to for your divorce settlement. When you reach a decision on a particular issue I will make sure that you consider what to do if things do not go according to plan. I will give you copies of the relevant laws but I do not represent either party and I will not tell you what to do. You will not receive legal advice from me. Instead, my job is to be a neutral facilitator of your negotiations between you and your spouse. I can provide you with the names of attorneys who have experience working with people who are in divorce mediation.

At the end of the divorce mediation, I will prepare your Divorce Agreement and the other paperwork necessary for you to file for an uncontested divorce. Although I will walk you through the process I do not go to court with you for the divorce hearing.
